Terms & Conditions of Ticket Purchase, Entry, and Liability

THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY, YOUR ASSUMPTION OF RISK RELATING TO EXPOSURE TO COVID-19 OR ANY OTHER COMMUNICABLE DISEASE, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.
BY PURCHASING A TICKET OR ENTERING THE PREMISES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.

I. Ticket Policy and Admission

  1. All Sales Final:
    All tickets, packages, and add-ons are strictly non-refundable. No refunds, credits, reimbursements, or exchanges will be issued for any reason, including but not limited to illness, travel delays, weather conditions, dissatisfaction with the event, or inability to attend.
  2. One-Time Ticket Change Policy:
    Guests may reschedule their ticket
    one (1) time only to another available date or time through our authorized third-party ticketing provider.
  • If the new slot is higher in price, guests must pay the difference.
  • If the new slot is lower in price, no refund, credit, or price difference will be issued.
  • After one change has been made, the ticket becomes fully locked and cannot be changed again under any circumstances.
  1. Admission Requirements:
  • Each ticket admits one (1) person unless otherwise noted.
  • A valid, government-issued photo ID is required for every guest.
  • Entry may be denied at the discretion of the Organizer for any reason, including intoxication, disorderly conduct, or violation of venue rules.
  • Re-entry is not permitted.
  1. Age Policy:
    Frosty’s Christmas Bar Austin is
    21+ at all times, without exception.
  • No minors (including infants or children accompanied by adults) will be admitted.
  • Failure to present valid ID verifying age will result in denied entry without refund.

II. Assumption of Risk and Waiver of Liability (Including COVID-19 and Other Infectious Diseases)

  1. Assumption of Risk:
    Attendance at any public event involves inherent risks, including potential exposure to COVID-19, SARS-CoV-2, or other communicable or infectious diseases. These may result in illness, injury, or death. You voluntarily assume all risks associated with entering the venue and participating in the event, including those arising from the negligence of the Organizer.
  2. Waiver and Release:
    You, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby waive, release, and discharge 2106 N Dallas Street LLC, Frosty’s Christmas Bar Austin, and all officers, directors, owners, employees, contractors, agents, affiliates, insurers, successors, and assigns (“Released Parties”) from any and all claims, liabilities, losses, or damages arising out of or relating to exposure to any communicable or infectious disease during or after the event.
    This waiver covers claims based on ordinary negligence to the fullest extent permitted by Texas law.
  3. Tickets Purchased for Others:
    If you purchase or transfer tickets to others, you confirm that all such individuals have reviewed and accepted these Terms, including this waiver and assumption of risk.
  4. Indemnification:
    You agree to indemnify and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) brought by any third party arising from or relating to your attendance, conduct, or violation of these Terms.

III. Health and Safety Acknowledgment

Guests must comply with all venue rules and any health or safety policies set by the City of Austin, Travis County, or the State of Texas.
The Organizer may refuse entry or remove any guest who fails to comply with safety guidelines, without refund.

IV. Conduct and Removal

Guests are expected to behave responsibly and respectfully. The Organizer may remove or deny entry to any guest for reasons including but not limited to:

  • Intoxication, drug use, or unsafe behavior
  • Harassment, discrimination, or verbal/physical misconduct
  • Destruction of property or theft
  • Failure to comply with instructions from staff
  • Violation of these Terms or any applicable Texas law

Guests removed for misconduct will not receive a refund or credit.

V. Limitation of Liability

To the fullest extent permitted by Texas law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to attendance at the event or any onsite activities, even if advised of the possibility of such damages.

VI. Binding Arbitration and Class Action Waiver

  1. Agreement to Arbitrate:
    Any dispute, claim, or controversy arising out of or relating to these Terms, your ticket purchase, or your attendance at Frosty’s Christmas Bar Austin shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA). Judgment on the arbitration award may be entered in any Texas court with proper jurisdiction.
    Both parties waive the right to a trial by jury.
  2. Class Action Waiver:
    You agree that any claim or dispute must be brought
    individually, not as part of a class, collective, or representative action. No arbitration may be joined or consolidated with any other proceeding without the written consent of all parties involved.
  3. Location and Governing Law:
    Unless prohibited by law, arbitration shall take place in
    Travis County, Texas, and these Terms shall be governed by the laws of the State of Texas and the Federal Arbitration Act.
  4. Informal Resolution Requirement:
    Before initiating arbitration, the complaining party must send a written notice describing the issue and proposed resolution to:

    Both parties agree to attempt informal resolution of the dispute for sixty (60) days before initiating arbitration.

VII. Governing Law and Venue

These Terms are governed by the laws of the State of Texas and the City of Austin.
If arbitration is not pursued, disputes must be brought exclusively in the state or federal courts located in
Travis County, Texas.

VIII. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

IX. Entire Agreement

These Terms constitute the complete and final agreement between you and 2106 N Dallas Street LLC regarding ticket purchases and attendance at Frosty’s Christmas Bar Austin. They supersede all prior agreements or representations.

X. Acknowledgment

By purchasing a ticket or entering the venue, you acknowledge that you have read, understood, and agree to all Terms and Conditions, including the waiver of liability, assumption of risk, arbitration agreement, and class action waiver.
